 I have a question about a ticket I received in Morton County. Who should I talk with?

Call either the municipal court or district court in the jurisdiction where you received the ticket. The court’s jurisdiction information is located in the upper left-hand corner of the citation you received at the time of the stop.

 Why is there a warrant for my arrest?

The Court will issue a warrant when one of the following applies:

  • You fail to comply with the orders of the Judge    
  • You fail to make payments as outlined in the judgment
  • You fail to appear on a charge which requires a mandatory appearance
  • You are unable to be located

 Do you accept credit cards for the payment of fines?

We accept Visa and Mastercard for payments of fines on criminal, traffic, or other non-criminal offenses. Cash, checks, and money orders are also accepted. When posting bond to get someone out of jail, you must pay in cash or with a surety bond. You may post bond with a credit card only at the Mandan Municipal Clerk of Court’s office during regular business hours. The court does not accept checks for posting of bond.

 What if I am unable to make my fine payment or complete any condition of my judgement?

Fines and conditions (evaluation, treatment, minor in possession classes, etc.) are due as ordered in the judgment. Failure to comply with a condition or to pay fines when ordered may result in an Order to Show Cause or Bench Warrant being issued. If for some reason you are unable to meet the requirements of the judgment you need to request an extension, in writing, with an explanation for the request and the date you will be able to comply. Said request must be sent to Municipal Court, 210 2nd Ave NW, Mandan, ND 58554. It is up to you to check back with the Clerk to see if your extension has been granted and when your next payment is due or condition must be completed.

 What will my sentence be?

On a Class B Misdemeanor the Judge can fine up to the maximum penalty of $1,000 and 30 days in jail. If anyone indicates to you what sentence you will receive, keep in mind that is their opinion, the sentence imposed is the sole discretion of the Judge. If you enter into a plea agreement, the judge may accept or reject the plea agreement.

 How do I get a public defender/court appointed attorney?

You must appear in court at your Arraignment/First Appearance to make a request for a court appointed attorney. When you appear you will be given paperwork; Rights Form and an Application for Court Appointed Attorney. A court appointed attorney is available ONLY on criminal charges. The Judge will make a decision at that time as to whether you qualify for a court appointed attorney or not. If an attorney is appointed it does not mean the attorney is free as you may be required to pay a portion of the fees.

 Does the Judge in Municipal Court perform weddings?

The Judge does perform weddings outside of the normal court activities. Contact the Municipal Court office with your names and wedding date. The Judge will contact you directly regarding arrangements. The Judge determines the fee depending on the venue. Prior to the wedding you must have obtained a marriage license through the Recorder's office. You will also need two witnesses to sign the marriage license.

Failure to set a court date or pay your ticket within 20 days may result in a warrant for your arrest and//or additional court fees.
